A North Carolina domestic violence protective order, often called a 50B, can be entered the same day and the full hearing follows within about ten days. Whether you need protection or you were just served, what you do in those ten days shapes the result.
How domestic violence protective orders work in North Carolina
Under Chapter 50B, a person who has a personal relationship with the abuser, such as a spouse, former spouse, dating partner, household member or parent of a shared child, can ask the district court for a protective order based on acts of domestic violence: bodily injury or the attempt, placing someone in fear of serious injury or continued harassment, or sexual offenses. An ex parte temporary order can be issued without the other party present if the judge finds a danger of acts of domestic violence.
A hearing on the full order is set within 10 days of the ex parte order. If granted, a DVPO lasts up to one year and can be renewed for up to two more years. It can order no contact, remove the defendant from the home, award temporary custody and support, and requires the surrender of firearms. Violating it is a crime. For people without a qualifying relationship, a Chapter 50C civil no-contact order is the parallel tool.
If you need protection
Document what happened: dates, messages, photos, witnesses. We help you prepare the petition so the judge sees the pattern, not just one incident, and we represent you at the hearing. A protective order can also address temporary custody, the home and support.
If you were served
Do not contact the other party, even to explain, even through friends or family. Violating a temporary order is a separate criminal offense. Save every message and gather your own evidence. The hearing comes fast and the consequences of a final order are lasting; talk to a lawyer before it.

How fast does the hearing happen?
The full hearing is scheduled within 10 days of the ex parte order. Continuances happen, but assume you have about a week and a half to prepare witnesses, messages and documents.
How long does a final order last?
A North Carolina DVPO lasts up to one year. The protected party can ask to renew it for up to two additional years. It isn't permanent on its own, but violations are criminal and the order stays in court records.
Will a protective order affect custody?
Yes. It is one of the factors the court weighs in a custody decision, and a final order can include temporary custody and parenting-time terms. That is one reason both sides should take the hearing seriously.
What if the petition is false or exaggerated?
It happens, especially around a divorce. The hearing is your chance to put on evidence and cross-examine. We prepare it like a trial, because it is one.
